    3. This policy applies to the processing of your (personal) data by Aperoller via our website available at www.aperoller.be, and not to other processing of your (personal) data, for example in the context of providing services to you.

      This privacy policy explains, among other things, which personal data we process via the website, how we process it, why we process it, what rights you have, and with whom we may share your data. We aim to inform you about this as transparently as possible.

    6. This privacy policy is governed by Belgian law. Only the courts of Antwerp (Antwerp division(s)) shall have jurisdiction in the event of a dispute.

      2. Any personal data that you voluntarily provide in an email or during a telephone conversation with us via the email address or telephone number mentioned on our website.

      3. Electronic data: device data, log file data such as IP address, browser and operating system, referring websites, visited pages (including date and time of connections) and cookies.

    3. Aperoller may receive your data directly from you when you provide them via the email address or telephone number mentioned on our website. We may also process your personal data through cookies on our website. You can consult our cookie policy​ here.

    4. The processing of the above-mentioned (personal) data is necessary for the purposes described in Article 5 below.

      1. Contact, inquiries and information (only if and insofar as you have contacted us yourself via the email address or telephone number mentioned on our website):
        We process your personal data via the website in order to contact you, to handle any questions you may have and to provide you with the necessary information about Aperoller, our services, our website or other information related to our services or activities.
        The processing of your data for these purposes is based on the legitimate interests of Aperoller insofar as these outweigh your (privacy) rights or interests.
        If you do not provide certain data, such as your identification details, it may not be possible for us to contact you, provide information or deliver services to you.

        Your data may be used for direct marketing purposes. This includes sending information about Aperoller, our services and activities or other information that may be interesting or useful to you.

Your data is also processed by our partners, service providers or suppliers with whom we cooperate in connection with the website, such as our website administrator(s), hosting provider(s) and/or IT partners, who process your data solely in connection with your visit to and use of the website.

    2. Aperoller may be required to disclose or process your data on the basis of a legal obligation and/or in response to a request from supervisory authorities or government institutions. 

  13. ARE YOUR PERSONAL DATA TRANSFERRED OUTSIDE THE EU/EEA?
    1. Your data will not be transferred to third parties in countries outside the EU/EEA without appropriate data protection safeguards.

    2. Any transfers to countries outside the EU/EEA will be based on appropriate safeguards and mechanisms, such as an adequacy decision by the European Commission. This is for example the case for third parties established in the United States that participate in the EU–US Data Privacy Framework, such as Google. 

  15. HOW LONG DO WE RETAIN YOUR DATA?
    1. We will not retain your data longer than necessary for the purposes described above in Article 5, unless specific legal provisions apply to the retention or processing of such data.

      Specific legal retention periods may apply to certain data. In all cases, the principle applies that we do not retain your data longer than necessary. If your personal data are no longer required for the intended purposes, we will delete or anonymize them where necessary.

       
  17. WHAT ARE YOUR RIGHTS?
    1. You have the right to be informed about the processing of your data via the website. This information is provided through this privacy policy. You can also always request additional information from us (via contact@terroir-tours.com).

    2. You have the right to request that we:
      1. Access your data;
        You can receive one copy of the requested information free of charge. If you request additional copies, we may charge a reasonable administrative fee.

      2. Rectification of your data (if necessary);

      3. Erasure of your personal data if:
        1. the processing of the data is no longer necessary for the purpose(s) for which it was processed;
        2. you withdraw previously given consent;
        3. you object to the processing by us;
        4. the personal data has been unlawfully processed;
        5. this is necessary to comply with a legal obligation;
        6. the personal data has been processed in connection with the offering of online services to children.

      5. Restriction of processing relating to you;
        1. You have the right to obtain restriction of processing if you:
        2. contest the accuracy of the data we hold;
        3. consider the processing unlawful and oppose the erasure of the personal data and instead request restriction of its use;
        4. we no longer need the data while you still require it for the establishment, exercise or defence of legal claims; or
        5. pending verification of whether the legitimate grounds of Aperoller override yours or your privacy rights after you have objected to processing based on our legitimate interest.

    4. You have the right to object to the processing of your personal data.

    5. You may at any time and free of charge object to the processing of your data for direct marketing purposes. This can easily be done by contacting us via contact@terroir-tours.com. You will then no longer receive marketing messages, communications or newsletters from us. Our mailings will always include the option to unsubscribe (opt-out).

    6. You have the right to data portability (to another data controller). This only applies where the processing by us is based on your consent or carried out by automated means.

    7. You have the right to request the personal data we have obtained from you in a structured, commonly used and machine-readable format and to transfer those data to another data controller. This right only applies if the processing by Aperoller is based on your consent or carried out by automated means.

    8. If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time.

    10. The exercise of your rights as described above is always subject to the requirements and conditions set out in the applicable legislation (such as the General Data Protection Regulation (GDPR)).

    11. To exercise the above rights, you may simply submit a request to Aperoller via: contact@terroir-tours.com. You must provide sufficient identification when submitting your request.

If we have reason to doubt your identity, we may request additional information necessary to verify and confirm your identity. We may request a copy of your identity card in order to verify who is submitting the request, insofar as this is necessary and proportionate. You should ensure that any information not required for verification of your identity is blacked out, removed, or otherwise made unreadable.
